2. Purchase Conditions

2.1 Scope of application

These conditions regulate the sale of products and services offered by Congas Ibérico S.L. through the website www.congas.es. They apply exclusively to purchases made directly on this website. Purchases made through third parties will be governed by the conditions of those third parties.

2.2 Formation of the contract

By placing an order on our website, the user makes an offer to purchase. The contract is not perfected at the time of the order, but when Congas Ibérico S.L. confirms its processing and shipping via email. The order confirmation email is solely an acknowledgment of receipt, not a definitive acceptance.

To make purchases on this website, you must be over 18 years of age or have the express consent of parents or legal guardians.

2.3 Prices

All prices indicated on the website include legally applicable VAT. Shipping costs, where applicable, will be shown separately before confirming the order.

Congas Ibérico S.L. reserves the right to modify prices at any time. However, the price applicable will be the one in force at the time the customer places the order.

In the event that a product appears with a clearly erroneous price, Congas Ibérico S.L. reserves the right to cancel the order, notifying the customer and proceeding to fully refund the amount paid.

2.4 Availability

The availability of products is subject to stock at the time of processing the order. If a product is not available after order confirmation, Congas Ibérico S.L. will notify the customer and proceed to refund the amount without delay.

2.5 Payment methods

The available payment methods are detailed on the Payment Options page of the website. Payment is required in full at the time of purchase. Payment data is securely managed by external payment platforms (Shopify Payments and PayPal), without Congas Ibérico S.L. storing card data.

2.6 Shipping and delivery

Shipping times and conditions are detailed in the Shipping section of the website. The indicated times are approximate. Congas Ibérico S.L. is not responsible for delays caused by circumstances beyond its control.

2.7 Right of withdrawal

In accordance with Royal Legislative Decree 1/2007 (General Law for the Defense of Consumers and Users), the customer has the right to withdraw from the contract within 14 calendar days from the receipt of the product, without needing to provide justification.

To exercise this right, the customer must notify Congas Ibérico S.L. through unequivocal communication (by email to contacto@congas.es or by phone) before the deadline expires.

The refund will be made using the same payment method used for the purchase, within a maximum period of 14 days from the notification of withdrawal. Return shipping costs are borne by the customer, unless the product is defective or does not match the order placed.

Detailed return conditions are included in the Returns Policy available on the website.

2.8 Legal guarantees

Products purchased from Congas Ibérico S.L. come with a 3-year legal guarantee established in Spanish consumer regulations for consumer goods. In case of a defective product, the customer must contact us at contacto@congas.es describing the detected defect.

3. Product Warranty

Spanish consumer regulations may grant the customer certain mandatory rights and guarantees. Nothing in this section is intended to limit or replace such legal rights. The conditions set forth below will apply to the maximum extent permitted by current legislation.

3.1 Legal warranty

In accordance with Royal Legislative Decree 1/2007 and Royal Decree-Law 7/2021 which transposes Directive (EU) 2019/771, all consumer goods sold by Congas Ibérico S.L. come with a legal warranty of 3 years from the date of delivery. During this period, the customer has the right to demand product conformity free of charge.

3.2 Congas commercial warranty for carbonation machines

In addition to, and without prejudice to, the customer's legal rights, Congas Ibérico S.L. offers a limited commercial warranty on carbonation machines purchased directly from www.congas.es. This warranty covers defects in materials and manufacturing under normal household use conditions for 1 (one) year from the date of purchase ("Congas Warranty").

To facilitate warranty management, the customer is advised to keep the proof of purchase (order confirmation email or invoice).

3.3 Coverage and exclusions

The Congas Warranty covers original defects in materials and workmanship. Damages resulting from the following are expressly excluded from the warranty:

–      Incorrect, negligent, or use contrary to the manufacturer's instructions.

–      Normal wear and tear from use.

–      Modifications, repairs, or manipulations carried out by the customer or unauthorized third parties.

–      Damages caused by accidents, impacts, falls, or external agents (humidity, extreme heat, etc.).

–      Use with incompatible CO₂ cylinders or those not supplied by Congas Ibérico S.L.

 

The warranty also does not apply to CO₂ cylinders themselves, which are subject to their own conditions of use set out in section 5 of this document.

3.4 Warranty claim process

If the customer believes their product has a defect covered by the Congas Warranty, they should contact us at contacto@congas.es, indicating the order number, a description of the defect, and, if possible, photographs of it.

If the defect is confirmed, Congas Ibérico S.L. will proceed to replace the item with an equivalent model. If the exact model is not available, it will be replaced by another of substantially equivalent functionality. This warranty does not entitle the customer to a refund.

Shipping costs related to warranty management will be borne by Congas Ibérico S.L. when the defect is confirmed.

4. Specific Conditions for CO₂ Cylinders

4.1 Direct purchase modality

When the customer acquires a CO₂ cylinder through the one-time purchase modality (outside the Soda Club), ownership of the cylinder is transferred to the customer at the time of physical delivery, after full payment of the price. In this case, Congas Ibérico S.L. will not claim the return of the cylinder.

However, Congas Ibérico S.L. offers the customer the possibility of voluntarily returning empty cylinders, thereby contributing to the company's reuse and environmental commitment.

4.2 Soda Club Modality — cylinders on loan

Within the framework of the Soda Club program, CO₂ cylinders are provided to the customer under a loan-for-use agreement. Ownership of the cylinders remains with Congas Ibérico S.L. at all times.

The customer pays a lower price than for direct purchase, in consideration of the obligation to return the empty cylinder when requesting a new order. The process is as follows:

–      The customer requests cylinders through the platform.

–      Congas Ibérico S.L. sends full cylinders and includes packaging material for the return of empty ones.

–      The customer returns the empty cylinders when placing the next refill order.

–      Cylinders must be returned in good condition, without damage or improper handling.

 

If the customer decides not to order new cylinders and wishes to leave the Soda Club, they must pay an amount of €10.00 (VAT included) for return management. This amount covers the logistical costs of collection.

Damaged cylinders or those with unauthorized modifications will not be accepted as valid for return.

5. Title, Risk, and Conditions of the License to Use

5.1 Transfer of title and risk — direct purchase products

Title and risk of products acquired through direct purchase (carbonation machines and CO₂ cylinders outside the Soda Club) are transferred to the customer at the time of physical delivery of the product. From that moment, the customer assumes full responsibility for the use, preservation, and possible damages derived from its handling.

Carbonation machines and cylinders acquired through direct purchase are not owned by Congas Ibérico S.L. once delivered. The customer is aware of the nature of the product—including that cylinders contain CO₂ under pressure—and declares to use them in accordance with the manufacturer's instructions, assuming the inherent risks of incorrect or negligent use.

5.2 Cylinders within the Soda Club framework — license to use

The CO₂ cylinders supplied within the framework of the Soda Club program are not sold to the customer. Congas Ibérico S.L. retains ownership of said cylinders at all times and provides them to the customer under a limited, personal, and non-transferable license to use.

This license to use exclusively authorizes the customer to:

–      Use the cylinder for domestic water carbonation with compatible carbonators.

–      Keep the cylinder in proper condition while in their possession.

–      Return the empty cylinder to Congas Ibérico S.L. under the conditions described in section 4.2.

 

The following actions are expressly excluded from the license to use:

–      Refilling the cylinder on one's own or through third parties not authorized by Congas Ibérico S.L.

–      Assigning, lending, selling, or transferring the cylinder to third parties.

–      Using the cylinder for purposes other than domestic water carbonation.

 

Failure to comply with these conditions will exempt Congas Ibérico S.L. from any liability for damages resulting from such misuse and may lead to the claim of the cylinder and compensation for the damages caused.

5.3 Assumption of risk by the customer

CO₂ cylinders contain gas under pressure. The customer declares to be aware of this circumstance and undertakes to always follow the use and safety instructions provided by Congas Ibérico S.L. and by the carbonator manufacturer. Congas Ibérico S.L. will not be responsible for damages or harm resulting from incorrect, negligent, or improper use of the product.

6. Soda Club Conditions

6.1 Nature of the program

The Soda Club is a voluntary membership program that allows customers to access special prices on CO₂ cylinders. It does not constitute a subscription with automatic periodic charges: each order implies a single and independent payment.

6.2 Enrollment and cancellation

Enrollment in the Soda Club is done by registering on the platform. Membership has no minimum duration and can be canceled at any time without additional cost, except as indicated in section 4.2 regarding cylinders on loan.

6.3 Benefits and conditions

The benefits of the Soda Club (preferential price, refill notifications, home collection, etc.) are valid as long as the customer maintains an active membership. Congas Ibérico S.L. reserves the right to modify the program's conditions, communicating them with reasonable notice.

6.4 Correct use of membership

The Soda Club account is personal and non-transferable. The assignment of program benefits to third parties or the use of membership for commercial resale purposes is prohibited.

7. Intellectual and Industrial Property

All content on the website www.congas.es—including, without limitation, texts, images, logos, photographs, videos, designs, source code, and the Congas brand—are the property of Congas Ibérico S.L. or third parties who have authorized their use, and are protected by Spanish and international intellectual and industrial property legislation.

Reproduction, distribution, public communication, or transformation of any content on this website is expressly prohibited without the express written authorization of Congas Ibérico S.L., unless expressly permitted by law.

The user may download or print content from the website exclusively for personal and non-commercial use, provided that copyright notices are maintained.

8. Website Terms of Use

8.1 Permitted use

Access to and use of this website is conditioned on its use in accordance with the law, morality, and these terms. It is prohibited to use the website for illicit purposes or that may cause harm to third parties.

8.2 Prohibited uses

The user agrees not to perform the following actions:

–      Use automated tools (bots, scrapers) to access, index or extract content from the site.

–      Attempt to breach security systems or access restricted areas of the site.

–      Perform reverse engineering of the site's software or code.

–      Impersonate Congas Ibérico S.L. or any employee or representative of the company.

–      Post or transmit defamatory, illegal, threatening, obscene, or infringing content.

The website may contain links to third-party websites. Congas Ibérico S.L. has no control over these sites and assumes no responsibility for their content, privacy policies, or operation.

9. Limitation of Liability

Congas Ibérico S.L. does not guarantee the continuous and uninterrupted availability of the website, nor the absence of errors in its content. The site is provided "as is" and "as available".

Except in cases where applicable law does not permit it, Congas Ibérico S.L. will not be liable for indirect, incidental, or consequential damages arising from the use of the website or the inability to access it.

The maximum liability of Congas Ibérico S.L. to the customer, in any case, will be limited to the amount paid for the products or services that gave rise to the claim.

10. Force Majeure

Congas Ibérico S.L. will not be liable for delays or non-compliance caused by circumstances beyond its reasonable control, including natural disasters, strikes, third-party supply failures, interruptions in telecommunications networks, or acts of public authorities.

11. Personal Data and Privacy

The processing of users' personal data is carried out in accordance with the provisions of the Privacy Policy, available at www.congas.es/pages/politica-de-privacidad, in compliance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD).

The use of cookies and similar technologies is regulated in the Cookie Policy, available at www.congas.es/pages/politica-de-cookies.

12. Applicable Law and Jurisdiction

These Legal Terms are governed by Spanish law. In case of controversy, the parties submit to the jurisdiction of the competent Courts and Tribunals in accordance with Spanish regulations.

If the customer is a consumer, the jurisdiction of their domicile will apply, as provided in Royal Legislative Decree 1/2007. For disputes in the field of e-commerce, the customer can also access the European Union's online dispute resolution platform: https://ec.europa.eu/consumers/odr

13. Modifications to the Conditions

Congas Ibérico S.L. reserves the right to modify these Legal Terms at any time. Changes will be published on this page with an indication of the update date. Continued use of the website after the publication of changes implies acceptance of the updated conditions.
